Procedure for Resignation of Management Committee Members and Office Bearers

Resignation by Management Commitee Member

As per section 129 of model byelaws, a Member of the Committee can resign from membership of the commitee by giving resignation letter to the chairman of the society.

Resignation becomes effective when it is accepted by the chairman of the society or secretary of the society. If both do not accept the letter within one month of receipt of the letter without giving any reasons, resignation is considered as accepted.

Resignation by Chairman of the Society

As per section 130 of the byelaws, chairman can submit his/her resignation letter to the secretary of the society. Outgoing chairman must hand over all documents to the newly elected chairman and by completing the work already given to him. He must hand over all papers and any property of the society to new chairman.

Resignation by Secretary or Treasurer of the Society.

The Secretary or Treasurer of the Society may resign his office as
Secretary or Treasurer by a letter addressed to the Chairman of the Society. Their resignation will be effective only after its acceptance by chairman and handing over the charge to the newly elected Secretary/Treasurer, as the case may be. Resignaton should be accepted onlyu after Secretary or Treasurer of the Society has brought upto date the work entrusted to him and has produced the entire papers and property of the Society, in his possession, before the Committee.

Resignation by Entire Management Committee

As per Section 130.e of the Model Byelaws, when entire management committee want to resign, a General body meeting should be conveyed and all management committee members shall place their resignations before the General Body.

Their resignations shall be effective from the date of acceptance of such resignations by the General Body.

This fact of acceptance of resignations of the entire Committee by the General Body, shall be communicated to the Registrar by the outgoing officers and Registrar may take necessary action as provided under section 77 A of the Act.

However the existing Committee shall continue to carry on with only routine functioning of the Society, till alternate  arrangement is made by the Registrar.
